Suspect in Glen Burnie killing to be tried as a juvenile

A judge last night ordered that a Glen Burnie teenager accused of stabbing another boy to death outside Marley Station mall be tried as a juvenile, ensuring his release by 2010.

Brandon Ian Kellam, 17, was charged as an adult with second-degree murder in the Sept. 3 death of Kevin Wengert, 17, of Glen Burnie, which carries a maximum sentence of 30 years in prison. The judge's ruling means he can only be held in a juvenile detention center until he turns 21.

Following several hours of testimony over two days, Circuit Court Judge Pamela L. North cited Mr. Kellam's "unstable and chaotic" upbringing with an alcoholic mother, an often-absent father and an abusive grandmother who once choked him.

Mr. Kellam has used marijuana, cocaine, Ecstasy and alcohol and tried to kill himself at least twice last year by cutting his arms - 38 times in one case. Having had mental health treatment off and on since the third grade, he was briefly held in a psychiatric hospital last year.

He's been prescribed medication at times, but never got effective and consistent treatment, a psychiatrist and social worker who spoke to him both testified. The psychiatrist said he believes Mr. Kellam has bipolar disorder.

"Apparently he had identifiable problems at a very young age that nobody cared enough about to treat," Judge North said.

She said Mr. Kellam will get that treatment and pose less of a risk to the public in the long term if he's tried as a juvenile rather than thrown into the adult system, which has limited resources.

The fatal brawl started when Mr. Kellam, who was at Marley Station with friends, got a call from another friend who said four people had tried to rob him on the B&A Trail and had punched him when he didn't give them money.

Mr. Kellam and other teens walked from the mall toward the adjacent bike trail to look for whoever had attacked their friend.

"In essence they were their own lynch mob," Assistant State's Attorney Lawrence Caporale said. "They were taking justice into their own hands."

Mr. Kellam, then 16, and his group found Mr. Wengert and three other boys coming out of J.C. Penney a little after 9 p.m. With his friend saying they were the ones who'd attacked him, Mr. Kellam suggested fighting at the bike trail, Mr. Caporale said.

They never made it, as one of Mr. Wengert's friends threw a punch that ignited several brawls.

Someone from Mr. Wengert's group - it's not clear who - got a metal baton out of a car. Three or four people then attacked Mr. Kellam's friend, Brad Smith, kicking and punching him as he lay on the ground. Accounts differed over whether the metal baton was used, though police did recover it.

Mr. Kellam ran away from the fight at one point, but ran back when he saw people attacking his friend "like a pack of dogs," said his lawyer, Peter S. O'Neill.

A butterfly knife in one hand and his belt in the other, Mr. Kellam grabbed Mr. Wengert and stabbed him twice, the prosecutor said. Mr. Kellam used such force that the knife broke two ribs and went through Mr. Wengert's lung and pulmonary artery. The knife was never found.

Mr. O'Neill said Mr. Kellam acted to save his friend's life.

"He didn't come back to stab Kevin Wengert; he came back to help someone who was helpless at the time," Mr. O'Neill said.

But Mr. Caporale pointed to the defendant's own statement, in which he said Mr. Wengert didn't have a weapon. The prosecutor said Mr. Kellam could have called police, fought with his fists or done something else to stop an unarmed man, but instead used a lethal weapon.

"He's made a bad decision and he must take responsibility for his actions as an adult, not as a child," Mr. Caporale said.

Judge North noted the prosecutor didn't counter much of the defense testimony, leaving her with "no question" that juvenile court is the proper venue.

The trial will likely be next week, which is when the adult case had been scheduled.

Mr. Wengert's parents wouldn't comment after the hearing. Mr. Kellam's father, Jack Kellam, said he was relieved.

"My heart goes out to Kevin's family," Mr. Kellam said. "Brandon's not a malicious kid. Nobody won here today."


 
They Bit Off More Than They Could Chew
Brandon's excuse for killing Kevin was that his friend was being beaten to death.  The funny thing about this, however, is that Brandon's friend never went to the hospital.  The police handcuffed him and took him to the police station.  He had a bruise on one eye and a fractured small bone in his face.  If you have four grown kids kicking and stomping your head in, wouldn't you think you would (1) be dead; (2) be unconscious; (3) have your head swelled three times the size; or (4) be taken to the hospital immediately?  Well of course none of this was done.  The friend went to the hospital three to four hours after the fight.  The kid was hit by one of Kevin's guys and he was then hoofed by one of Kevin's guys because he used a  weapon on him.  The metal baton did not belong to Kevin's guys, it belonged to Brandon's friend, and one of Kevin's guys picked it up, hit one of the kids with it, and threw it down because it was like a spring, it bounced right back off.  All of Brandon's friends had weapons and Brandon had the knife.  He's used a knife before and carries it all the time.  Brandon took off and ran and hid after Kevin hit him and then when Kevin's back was turned, he ran out of nowhere and stabbed Kevin when he didn't even see him coming.  What a tough guy?  He's a sociopath who doesn't give a rat's ass that he killed somebody.  He kills animals, he's had several assault charges, he's had drug charges, and he is tried as a juvenile.  He belongs in prison with the big boys to pay for what he did.  Not some kiddie camp that will deal with his "mental problems."  His mental problems are mood related and behavioral related.  Well what teenager doesn't have "mental problems" of some kind???  Does that mean that they go around and intentionally kill people.  Brandon knew that he was going to seriously injure Kevin when he went for his chest, but just stabbing him wasn't enough he had to pull the knife down and cut his ribs, cut his lung and then his main artery.  The Shock Trauma doctor said it was one of the worse stab wounds he had ever seen.  He couldn't believe that he was tried as a juvenile.  He said this was meant to kill not to injure.  Now this little piece of trash will be out on the street in a few years after he murdered an unarmed person that happend to be my son.  Brandon said that when he gets out he's going to have a good life, and have a girlfriend, play his guitar, and lift weights.  Well isn't that nice???  The murderer gets to make great choices does he???  His ass belongs in Jessup for 30 years or more.  Maybe then we wouldn't have to worry about him being on the streets.  He has never said a word to me about killing my son, never apologized, nothing.  He could care less.  He has smiled at me on several occasions in the courtroom.  He kills animals, he smiles becuase he is a juvenile now, all the tendencies of a sociopath.  Believe me, more blood will be spilled when he gets out of wherever he is going.  Nobody seems to want to deal with him that is why we have to keep going back to court because he cannot get placed.  Well what in the hell does that tell you??  It tells me that he should be in jail like the rest of the sociopathic murderers not in a kiddie camp.  If he was so mentally disturbed why didn't his father and mother have him in  anuthouse instead of a regular school???  He went to school, got high, drank, played in a band, seemed to be living the "high" life so how come all of a sudden he's mental???  Because that is the grandious excuse now for murderers in Anne ARundel County under 18.  There have been so many murders in Maryland since Kevin died, and almost all of them that were comitted by people under 18 where charged as adults, as was Brandon, indicted as adults, as was Brandon, and then tried as adults and sent to prison, real jail not kiddie camp.  If you are going to comit a crime of murder, make sure you do it in Anne Arundel County, because God knows just say your crazy and your mother is a drunk and your father spends too much time with his girlfriend and you will sure to be given sympathy and tried as a juvenile for intentionally taking the life of another human being.  We will see what a wonderful life Brandon Kellam will have.  He's delusional if nothing esle.  His expert testified that he thought he was bipolar however, the expert was paid to said whatever he was told to say, he performed no psychological tests on Brandon, he took Brandon at his word as did the Department of Juvenile Justice.  Well Brandon and his father can say whatever the hell they want to say - the kid is on a murder charge.  I've never seen such a travestry of justice in my life and I hope with all my heart that Brandon Kellam's life is doomed as he is a total piece of human garbage that doesn't deserve to breathe the air that decent human beings breathe.  My son is gone because Brandon Kellam chose to kill him nothing more, nothing less.  He is a MURDERER and always will be.  You do not stop being a MURDERER.  If you are 17 years old and have the rap sheet that he does and now has a murder charge, does that sound like a "pitiful little child" or does it sound like a Jeffrey Dahmer in the making?  I would go for the latter.

July 22, 2008 - REVIEW HEARING
The little piece of shit was proclaiming he's a changed person now.  He got straight A's in school, he doesn't even want to do drugs or drink anymore, etc.  He's a choir boy!!!!  His father wants to spend more time with him and take him to ballgames - well isn't life a bitch.  The little bastard got a free ride as a juvenile and now he wants to go to ballgames.  Is there any justice in this world and people wonder why people take justice into their own hands.  Kills me.  I voiced my opinion that I can't take my son to a ballgame or talk to him or touch him either because Brandon Kellam murdered him for nothing.  Brandon Kellam will be released in March of 2010 when he turns 21.  Life's tough on him I could hear that in his voice.  LOL.  He didn't one time ask for forgiveness for what he did.  There was no affect in his voice whatsoever.  He's the same psycho he was when he went into the kiddie camp and that disgusting probation officer of his is the pits to say the least.  She's on the poor Brandon wagon too.  One of the social workers in Michigan had the audacity to say "I trust Brandon 100%."  I'm like yeah he isn't around your child either.  They all make me sick.  Karma is a bitch and I definitely believe in what goes around comes around but tenfold.  Kevin mommy will always be there for you no matter what.  You aren't dying for nothing buddie believe me.  I'll be at every hearing and fight this every step of the way but Brandon Kellam's life isn't going to be any free ride believe me.  He's garbage.
